The defendant pleaded guilty to a charge of burglary and was placed on probation for a period of 3 years. One of the conditions of probation required that he serve 14 days in the county jail. Another condition was that he should not possess any firearm. He served the jail term. Some 4 months later he was charged with violation of his probation for possession of a firearm. He pleaded guilty to that violation. The order of probation was thereupon set aside and the defendant was sentenced to the Division of Corrections for a period of not less than 1 year nor more than 3 years, with credit allowed for the 14 days served in jail. The defendant has appealed challenging the imposition of a jail sentence as a condition of probation. The 18-year-old defendant was a high school graduate. The burglary here was his first felony offense. He was placed on probation on August 25, 1972, following a conviction under section 28-532, R. R. S. 1943. Conviction for this offense ""shall be punished by imprisonment in the Nebraska Penal and Correctional Complex not more than ten years nor less than one year, or by a fine not exceeding five hundred dollars, or imprisonment in the jail of the county not exceeding six months."" § 28-532, R.
